Ventsim™ software is a propriety software item for mine ventilation which is developed and sold exclusively by Chasm Consulting Pty Ltd. The software is intended for general use by mining site, consultants, universities, researchers and students. Some engineering knowledge or training is assumed for the effective use of the product.
Standard Payment Policy (except where agreed otherwise)
Sales within Australia: Formal purchase order required with payment made within 30 days of invoice, or in the absence of a company purchase order, then payment is required prior to licence creation. Payment must be in Australian dollars (AUD).
Sales outside Australia: Unless otherwise agreed with Chasm Consulting, payment to be made prior to the provision of licences to the purchaser, in United States Dollars (USD).
Provision of a Ventsim™ licence to a customer or client will normally occur via email within 24 hours of payment confirmation.
Other Ventsim™ Services
Ventsim™ Training: Payment required prior to training course commencement.
Ventsim™ Consulting: As per individual arrangements with Chasm Consulting.
Ventsim™ Hardware: Where hardware (such as computers) is to be purchased on behalf of the client, payment must be made by the client before item is purchased.
When purchasing from Chasm Consulting, card details are transmitted through a secure server using eWAY® (http://www.eway.com.au). Card data is not hosted by Chasm Consulting after processing.
Cancellation and Refunds
Ventsim™ Licences: No refund will be payable after the provision of a Ventsim™ licence to a client. Ventsim™ Software and Chasm Consulting Pty Ltd reserve the right to revoke a software licence if it is found to be in use outside the scope of the defined licence (for example, a breach of copyright or piracy of software).
Ventsim™ Training: Cancellation refund will be as per the policy stated on the training course application. If the policy is not stated, the refund arrangement is:
- Greater than 30 days: Fully refunded.
- Less than 30 days, more than 1 week: Full refund minus portion of fixed course costs incurred by Chasm Consulting (e.g. deposit for training facility).
- Less than 1 week: No refund possible. Course substitutions with other persons are permitted.
Ventsim™ Consulting Services: No cancellation or refund of monies owned from work or consulting services provided by Chasm Consulting will be payable once such work is performed.
Product Licence Support
All Ventsim™ Licences (with the exception of rental licences) are sold with a limited time included upgrade and maintenance support, from the date of purchase. Updates and upgrades can be freely downloaded from the www.ventsim.com website and installed at any time by the user during this time. Continued support after the initial maintenance period is available through an optional annual maintenance fee.
Technical support during this period will be provided via email, normally within 48 hours or less of a question being asked. Technical support is limited to questions, queries or problems the purchaser may have using the software. Technical support is not intended for extensive training or tuition, nor is it intended to provide extensive assistance building or validating models. Such additional services may be available through chargeable services provided by Chasm Consulting Pty Ltd.
Warranty and Fitness for Purpose
Ventsim™ Software and Chasm Consulting do not specifically warrant the suitability of this product for use in any specific application. The product has been built on broad industry knowledge and experience and has successfully been used at many locations around the world, however the product is supplied “as is” with no specific guarantee for suitability of purpose or accuracy of results.
In no event shall the author of Ventsim™ products, Chasm Consulting or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information or any other pecuniary loss) arising out of the use of or inability to use the software product or the provision of or failure to provide support services, even if the supplier has been advised of the possibility of such damages.
